If you are domiciled in the United States of America your request for removal must be made in accordance with the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act ( 17 U.S.C. § 512 ) which confirms that the notice must include substantially the following:

 

  • The signature (physical or electronic) of the personal authorised to provide notice.
  • A description of the copyrighted work you believe to have been infringed (including the location of this work).
  • Adequate contact information so that we can contact you.
  • A statement that you have a good faith belief that use of the copyrighted material is not authorised by the copyright owner, its agent or the law.
  • A statement that the information you are providing us is accurate.
  • A statement (made under penalty of perjury) that you are authorised to act on behalf of the copyright owner.

Counter-Notice:

 

If you believe that a notice of copyright infringement has been improperly submitted against you, you may submit a Counter-Notice which contains:

  • The signature (physical or electronic) of the personal authorised to provide notice;
  • Identification of the material removed or to which access has been disabled;
  • A statement (under penalty of perjury) that you have a good faith belief that the removal or disablement of the work was a mistake or that the material was misidentified;
  • Adequate contact information so that we can contact you.
  • A statement that you consent to the jurisdiction of the Federal District court (i) in the judicial district where your address is located if the address is in the United States, or (ii) the state of New South Wales, Australia, if your address is located outside the United States.
